Emily Troesch practices in the areas of construction law, commercial litigation and insurance law. In the construction sector, she assists clients in all aspects of construction contracting and dispute resolution, providing clients with result-driven and cost-effective solutions. She has experience litigating construction project issues such as cost overruns, differing site conditions, changes and extra work, mechanics’ liens, and construction defects, and has represented owners, engineers and architects in prosecution and defense of professional negligence actions in relation to construction defects, Florida building code compliance, plans and specifications and wrongful death. She also assists clients during pre-contract activities including proposal preparation, bid protests, contract preparation and negotiation.
Ms. Troesch also has experience in representing businesses and individuals in a wide-variety of general and complex commercial litigation matters including, but not limited to, civil theft, fraud, defamation, breach of contract, landlord tenant matters, and tortious interference with business and contract. She also has experience representing first-party property plaintiffs and defendant insurance companies in relation to homeowner and commercial insurance policy claims and litigation including assignment of benefits claims.
Prior to joining the firm, she practiced in the areas of complex construction and commercial litigation, surety defense, appellate law, insurance defense, banking and real property.
Ms. Troesch has successfully argued for and against numerous motions for summary judgment, discovery motions, and has taken a plethora of contentious depositions in a vast array of different construction, commercial litigation and first-party property insurance matters.
During law school, Ms. Troesch served as the Executive Editor of the Journal of Transnational Law and Policy. Her passion for writing has also led her to author countless complex dispositive motions and memoranda of law, as well as state and federal appellate briefs in all of the above-mentioned practice areas.
