Annual Community Association Registration Deadline Approaches

If you are part of a residential community association in Miami-Dade County, it is time to ensure your compliance with the “Miami-Dade County Ordinance for Registration of Community Associations.” This ordinance, codified under Chapter 17-D of the Miami-Dade County Code of Ordinances, has been in effect since March 1, 2022, and mandates annual registration for all residential condominium, cooperative and homeowners’ associations within Miami-Dade County.

Ordinance Requirements for Community Associations  

Each year, by February 1, all applicable associations must file an online registration with the Miami-Dade County Department of Regulatory and Economic Resources. This filing and any required renewal fees must be paid and updated annually. It is important to note that this requirement applies to all residential associations, regardless of their size or location within Miami-Dade County, including incorporated and unincorporated areas. However, associations governing solely commercial properties are exempt.

What Information Needs to Be Filed? 

The annual registration includes a comprehensive set of details about the association. Examples of the information required include but is not limited to:

  • Association name and address.
  • Names of property manager, officers and directors.
  • Copy of governing documents.
  • Annual budget and approved special assessments.
  • Most recent audited financial statements.
  • Structural reports and insurance policies.

In 2023, the ordinance was amended to add specific reporting requirements for capital projects funded by special assessments. Associations must now provide:

  • Project schedules.
  • Projected and actual commencement/completion dates.
  • Estimated and actual project costs.
  • Sources of funding for capital improvements.

The information submitted is maintained in a publicly accessible online database, making it easier for community members and the public to access key details about their associations. Failing to meet the filing requirements can result in penalties, so compliance is critical.

Associations can complete their registration through the Miami-Dade County Community Associations Registry and Resources Portal, which provides instructional resources to help associations navigate the filing process.
