As you may be aware, recent updates to the Condominium Act (ss. 718.112(2)(g)9 & 10, F.S.) and the Cooperative Act (ss. 719.106(1)(k)9 & 10, F.S.) require associations to submit a statement to the Division within 45 days of receiving their structural integrity reserve study (SIRS). This statement must confirm that the study has been completed and that it has been provided or made available to all unit owners, as required by law.
After a prolonged wait, the Division has published an electronic form on its website to facilitate compliance with this requirement. You can access the website here.
Associations must use this form when submitting their statements to the Division. Importantly, even if you have previously submitted an unofficial notice, you are still required to complete this new electronic form, as it requests more detailed information than what is specified in the statute.
For example, the Division’s form requires associations to provide:
- A copy of the structural integrity reserve study (SIRS);
- The name of the individual or company that conducted the study;
- Whether the association has levied an assessment as a result of the study;
- And additional information.
We strongly advise all associations to complete and submit this form as soon as possible to ensure compliance with these new statutory obligations.
