Mr. Rodgers-da Cruz is a shareholder and the Chair of the Construction Defect Trial Department.
Mr. Rodgers-Da Cruz has been with Siegfried Rivera since 2005, and practices throughout the State of Florida in the areas of Community Association Law, Complex Construction Litigation, Construction Defect Litigation, and Commercial Litigation on behalf of community/condominium associations, developers, public health facilities, assisted living facilities, property owners, general contractors and subcontractors.
In his construction defect practice as lead or co-lead counsel, he has prosecuted or defended over 100 complex, multi-party, construction defect claims on behalf of homeowners/condominium associations, developers, public health organizations, assisted living organizations, property owners, general contractors and subcontractors. These claims involve defective design, construction, and manufacturing defects of virtually all building components, including roofs and roofing systems, waterproofing systems, pool decks, underground parking garages, seawalls, stucco, concrete, steel, post-tensioning, windows, sliding glass doors, balcony railings, fire sprinkler and life safety systems, drywall, and paint/coatings.
Mr. Rodgers-da Cruz also represents clients in all phases of the construction process, including: pre-construction contract negotiation, construction disputes during the course of the project, and project completion. His construction defect and litigation experience provides him with insight into properly setting up the project, managing project disputes, defects, and overall risks. He routinely represents condominium associations in remediation projects and pragmatically assists in framing the client’s overall goals and objectives has for the project. From there he assists in vetting all pertinent parties to the project and negotiates and drafts all applicable contracts.
Upon graduating from law school, Mr. Rodgers-da Cruz served as an Assistant Public Defender in Brevard and Miami-Dade counties, gaining significant jury trial experience. He has served on the City of Miami's Green Commission and the Green Buildings Subcommittee, a commission focused on guiding and molding the city's environmental policy, whose members represent a cross-section of local experts and community enthusiasts. He is also a member of the American Bar Association Forum on the Construction Industry and Steering Committee Member for Division 1 - Litigation and Dispute Resolution.
Mr. Rodgers-da Cruz was recognized as a 2009-2014 "Rising Star" by Florida Super Lawyers. He was also recognized as a "Super Lawyer" under the construction litigation category in 2019-2021. He has been recognized in "Florida Trend's Florida Legal Elite" for 2015, 2016, 2019 and 2021 and has been recognized in the 2019-2023 editions of Best Lawyers in America - Construction Law.
Mr. Rodgers-da Cruz regularly conducts seminars on construction/construction defect litigation on both the plaintiff and defense side, including speaking at seminars hosted by the Latin Builders Association, Inc., the National Business Institute, Lorman, and the American Bar Association's Forum on Construction Law.
