Enforcement of Governing Documents
SRHL’s attorneys regularly advise association directors on all of the enforcement tools available to them under their governing documents by conducting comprehensive reviews of their declarations, articles of incorporation, bylaws, and rules and regulations, as well as Florida law as it relates to the proper procedures in documentary enforcement, suspension of use and voting rights, fines, evictions, pre-suit mediation, arbitration and litigation. Our firm assists in informing unit owners of alleged violations of the governing documents and applicable rules governing disputes, along with requesting and securing corrective action by the owners.
Before imposing fines and suspensions, Florida law has specific requirements that need to be followed, as the failure to follow the correct procedures may expose an association to liability. Our attorneys advise community associations on the proper procedures to undertake in order to provide for the uniform enforcement of governing documents and ensure homeowner compliance.
