PRIMARY FOCUS & EXPERIENCE

Berenice Mottin-Berger joined the firm in 2015 as a law clerk and became an attorney upon admission to the Florida Bar. Her practice is primarily focused on complex commercial and construction litigation, as well as in community association law. Ms. Mottin-Berger has experience litigating cases on behalf of plaintiffs and defendants involving: defective construction, contractual disputes, director and officer claims, and condominium disputes. In her role as general counsel to community associations, Ms. Mottin-Berger assists on all operational matters, including: evictions, owner conflicts, lease disputes, election recalls, and annual meetings. Ms. Mottin-Berger’s clients include condominium associations, homeowner associations, contractors, individual homeowners, and developers.

Obtained significant favorable verdict in case tried before the International Centre for Dispute Resolution (ICDR).
Participated in trial preparations and negotiations resulting in numerous sizeable settlements between condominium associations, developers, general contractors, engineers and sub-contractors.
$40.6MM jury verdict on behalf of a Miami Condominium Association against its developer for breach of statutory implied warranties due to construction defects and deficiencies with a robotic parking system.
Obtained sizeable settlements on behalf of clients in multi-party construction defect disputes.

Ms. Mottin-Berger was recognized in the 2023-2024 Best Lawyers in America: Ones to Watch listing under the construction litigation practice area. She was also recognized as a “Rising Star” in the Construction Litigation category from 2020-2024 by the Florida Super Lawyers listing.

While in law school, Ms. Mottin-Berger completed the University of Miami’s Litigation Skills program with Honors and was a member of the Charles C. Papy Jr. Moot Court Board. As a member of the Moot Court Board, Ms. Mottin-Berger competed in national competitions where she received awards for her brief writing and oral advocacy skills. Ms. Mottin-Berger also interned for the Honorable Kathleen M. Williams, United States District Judge for the Southern District of Florida during law school.
